Trump proposes removing vape regulation from FDA control

The Trump administration has quietly announced new plans for tobacco and e-cigarette regulation ahead of the 2020 election.

The plans were mentioned as part of the President’s $4.8 trillion budget plan for 2021.

They include moving tobacco regulation from under FDA control and establishing a new regulatory body under the US Department of Health and Human Services.

The agency would be led by a Senate-confirmed director.

The proposal has been met with strong condemnation from the health community.

The proposal states:

“A new agency with the singular mission on tobacco and its impact on public health would have greater capacity to respond strategically to the growing complexity of new tobacco products.

“In addition, this reorganization would allow the FDA Commissioner to focus on its traditional mission of ensuring the safety of the Nation’s food and medical products supply.”

The FDA has regulated tobacco products since 2009 through the Family Smoking Prevention and Tobacco Control Act.

E-cigarettes have been controlled as tobacco products since 2016.

President Trump will need the approval of congress if this plan is to go ahead.

Democrats have criticised the move stating that it would still allow children to access vape products.

With a Democrat-controlled House of Representatives and a Republican-Controlled Senate, the plans may look very different once they are approved.

This proposal is a complete change from the ban suggested by the President last year and the current flavour restrictions.

It also detours from last year’s proposal to force e-cigarette companies pay $100 million in user fees.
